PERSETUJUAN<\/h1>\n

TEKNIS PEMENUHAN BAKU MUTU EMISI<\/p>\n

Persetujuan Teknis Emisi (Pertek Emisi) merupakan persetujuan dari Pemerintah Pusat atau Pemerintah Daerah, klasifikasinya disesuaikan dengan kewenangan yang telah ditentukan pada PermenLHK No.4 2021.<\/p>\n

Mengacu pada Pasal 1 angka 93 PP No. 2 Tahun 2021, kewajiban pemenuhan standar emisi berupa ketentuan mengenai Standar Perlindungan dan Pengelolaan Lingkungan Hidup dan atau Analisis Mengenai Dampak Emisi yang dihasilkan dari sebuah usaha dan atau kegiatan seusai peraturan perundang – undangan usaha dan atau kegiatan yang melakuakn pembuangan emisi.<\/p>\n

DASAR HUKUM<\/h1>\n

Kewajiban Pelaku Usaha yang melakukan pembuangan Emisi untuk membuat persetujuan teknis (pertek emisi) berdasarkan pada beberapa dasar hukum yang telah diterapkan sejak tahun 2020:<\/p>\n

Undang – Undang (UU) Nomor 11 Tahun 2020 tentang Cipta Kerja Peraturan Pemerintah Nomor 22 Tahun 2021 tentang Penyelenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup Permen LH No 5 Tahun 2021 tentang Tata Cara Penerbitan Pertek dan SLO Pengendalian Pencemaran Lingkungan.<\/p>\n

Perusahaan yang memiliki usaha dan atau kegiatan yang melakukan pembaunagan emisi awajib memiliki Persetujuan Teknis Emisi (Pertek Emisi). Pertek Emisi diperlukan untuk perusahaan yang menghasilkan emisi gas buang atau partikulat dari proses produksi dan operasionalnya.<\/p>\n

Persetujuan ini penting untuk memastikan bahwa tingkat emisi yang dihasilkan oleh perusahaan tetap berada dalam batas yang diizinkan oleh regulasi lingkungan yang berlaku. Dengan memiliki Pertek Emisi, perusahaan menunjukkan tanggung jawabnya terhadap lingkungan dan berkomitmen untuk mengelola dampak negatif emisi pada udara dan lingkungan yang dihasilkannya secara komprehensif dan sesuai standar yang diterapkan.<\/p>\n

DOKUMEN<\/h1>\n

Idealnya Pengurusan Pertek Emisi dilakukan sebelum perusahaan mendapatkan persetujuan lingkungan dan izin berusaha, langkah – langkahnya menjadi penting dan krusial dalam menjalankan operasionalnya.<\/p>\n

Apabila kegiatan opersional sudah berjalan, pengurusan pertek emisi juga menjadi wajib untuk disegerakan dengan tujuan memwujudkan industri yang sustainable dan mentaati peraturan yang berlaku. Nantinya pertek emisi akan diintegrasikan ke dalam Persetujuan Lingkungan<\/p>\n

Hal ini dimaksudkan untuk memastikan aktivitas perusahaan sesuai regulasi dan standar yang berlaku.<\/p>\n

Jenis Dokumen Pertek Emisi dibagi menjadi dua, yaitu Kajian Teknis dan Standar Teknis. Untuk menentukan jenis Dokumen yang akan disusun nantinya akan dilakukan penapisan mandiri, hal ini menyesuaikan dengan kriteria besaran dampak emisi yang dihasilkan dari kegiatan usaha, sesuai dengan KBLI-nya. Untuk dampak emisi tinggi perlu menyusun Kajian Teknis, sedangkan untuk dampak emisi menengah dan rendah perlu menyusun Standar Teknis.<\/p>\n
